Appeasing the resident parent can seem at times to be paramount in proceedings. The CAFCASS recommendations would usually manage this by suggesting a progressive or stepped order that may take months before the non resident parent establishes a sensible and reasonable pattern of contact. Unfortunately, too much hope can be pinned on CAFCASS taking a pragmatic where the resident parent is highly or even irrationally anxious. At the conclusion of the report recommendations are provided to the court and both parties.ĭuring this time, there is little that the non resident parent can do but to keep calm and go with the flow, however illogical or unfair the position of the resident parent may be. During this period, CAFCASS may frequently be required to prepare a Section 7 report investigating the family history, circumstances, concerns, allegation and proposals. The significant frustration and reality is that from application to Final Hearing can take 6 months +. Typically, this can be an absence of any contact, contact centre supervision, or other forms of supported contact arising out of the concerns the resident parent has in relation to the other party. Therefore, until the Final Hearing the arrangements are dictated by the resident parent and what they are willing to agree to. Unfortunately, this is simply not the case.Īn interim Child Arrangements Order can only be made outside that of a contested or Final Hearing if both parties consent. Many applicants as the non resident parent wrongly believe that at the first hearing, the court can impose an order for child arrangements on the other side and can move issues forward quickly and pragmatically. If you find yourself in this position, don't try to fight the system but instead to understand and work within it.
